Judge Nelson sides with NFLPA
 
The NFLPA continues to enjoy a home court advantage in Minnesota, as Judge Susan Nelson sided with the NFLPA on Monday and allowed the NFLPA to have the lockout lifted. Judge Nelson continues the trend started by Judge David Doty in seemingly coming through for the NFLPA on many rulings. The NFL immediately announced it will seek a stay from the ruling and appeal the Judge's order to the Eighth Circuit Court of Appeals.

Read Judge Nelson's 89 page ruling issued on Monday. It appears Judge Nelson is a student of sports law history as she traces the current issues as far back as the Mackey case, which we briefly looked at last week as well as the Rozelle Rule.

The NFL continued to insist that the best way to get a deal done is through negotiation and not litigation. Meanwhile, the NFLPA certainly realizes that they have just won a battle and have momentum on their side. In effect, the NFL talking about negotiation is not much different from two fighters, where one fighter is in a head lock and down and yet asks that his opponent discuss the issue in a civilized manner.


NCAA to The Ohio State University-  Ethical Misconduct by Tressel
 
The Ohio State University has received its Notice of Allegations from the NCAA and the news is not good for the Buckeyes.  The NCAA found that Tressel, "knew or should have known that at least two football student-athletes" got benefits from Edward Rife, and, because the coach failed to report what he knew, he, "permitted football student-athletes to participate in intercollegiate athletics competition while ineligible." In their report, the NCAA concluded that Tressel's conduct was unethical in that he, "failed to deport himself in accordance with the honesty and integrity normally associated with the conduct and administration of intercollegiate athletics."

MLB picks Schieffer to run Dodgers
 
The former president of the Texas Rangers, J. Thomas Schieffer, has been named to run the Los Angeles Dodgers. As you may recall from last week, Major League Baseball stepped in to take over the Dodgers from troubled owner Frank McCourt.

Two interesting bits of trivia here:   First, Schieffer is the younger brother of Bob Schieffer of Face the Nation fame. Second, Schieffer is currently senior counsel at Akin Gump Strauss Hauer and Field, which is one of the primary sponsors of the annual Sports Lawyers Association conference set to take place in May in Washington, DC.
