March Madness trademark infringement; Jordan ok'd to buy Charlotte Bobcats; Andre Agassi has statute of limitations protection; Wickmayer and Malisse appeals

March 18, 2010

The LA Times had an article last year at this time that is just as relevant today on March Madness trademark infringement.   Also see SLT blog of 3/16

THE NBA Board of Governors has approved the sale of the Charlotte Bobcats to Michael Jordan.  Former majority shareholder Bob Johnson retains a minority stake in the team.

The International tennis Federation (ITF) is not going to pursue any action against Andre Agassi who admitted drug use in 1997 in his recently published autobiography. Despite World Anti-Doping Agency (WADA) requests to look into the matter, the ITF realized that the statute of limitations will not allow the Federation to go back 13 years to investigate the matter.

In other tennis related drug news, players Yanina Wickmayer and Xavier Malisse (absence of malice in Brad Gilbert lingo) two Belgians players who were suspended for violating WADA'S whereabout rules, (the players had their suspensions lifted back in December) have their appeals pending before the Court of Arbitration for Sport. Additionally, Wickmayer has taken the matter to the European Commission and the European Court for Human Rights. Wickmayer claims she was not properly informed of the reporting requirements for drug testing.  Her pursuit of her claim may lead to a change in the WADA rules, outlined below.

WADA rules require that elite athletes be available for out-of-competition testing for one hour a day, 365 days a year. Three months’ notice is required as to where the players will be so that they can be tested.
