Injury Settlements In The NFL, Part III

After some give and take between the assistant general manager and the injured player's agent, a deal on an injury settlement was finally reached. The team, naturally, would seek as short of time period as possible. Whereas the agent would look to get as many game checks as possible. Initially the team had offered three weeks of pre-season pay. Because the player sought a second opinion, and was found to be in need of surgery, the settlement needed to reflect a much longer time period.
Though the player and agent sought to get at least 12 weeks of regular season pay, they settled for 10 weeks of regular season pay. This included the period of recovery after surgery and about three to four weeks of rehab after surgery, So the player will receive 10 regular season game checks, at the split salary rate. The following are some things to think about if you are an agent or team representative preparing an injury settlement.
1. Always get a second opinion. If you are with a team, expect the agent to seek a second opinion.
2. The injury should be specifically detailed on the injury settlement form. The more specific it is, the better for both parties.
3.. If the player gets at least three weeks of regular season pay he is entitled to a credited season.
4. The player should not waive his workers comp rights.
5.Expect the player and agent to reserve any and all rights he may have under state and federal law.
