Injury Settlements In The NFL, Part II

August 10, 2009

The Agent’s response

Upon learning from the assistant general manager of his client’s injury, the agent was quick to respond. Instead of agreeing to a three week pre-season injury settlement, the agent informed the assistant general manager of his player's right to a second medical opinion under the Collective Bargaining Agreement. Although the assistant GM once again stated that it was a minor injury, he reluctantly agreed to let the player get a second opinion.

The agent and his client agreed that the player would fly back to his home town to be examined by an orthopedic surgeon he had used since his high school days. This physician immediately ordered an MRI of the player’s injured knee.

The results of the MRI evidenced a torn lateral meniscus in the right knee, and that required surgery. The doctor’s estimate was that recovery would take 6-8 weeks, with an additional 4 weeks for rehab.

The agent took this back to the team and asked that the injury settlement allow for ten regular season game checks for his client. The team was not happy with the second opinion, and proceeded to place the player on injured reserve. Meanwhile, they tried to resolve the issues with the player and the agent.

Tomorrow - Negotiation of the injury settlement.
